Erb's Palsy (Erb-Duchenne Palsy) is a paralysis of the arm caused by injury to the upper group of the arm's main nerves. If you, your child, or someone close to you, have suffered from Erb’s Palsy, then you will need specialist legal advice to successfully pursue a erb's palsy compensation claim. The most common cause of Erb's palsy is dystocia, an abnormal or difficult childbirth or labour. The paralysis can be partial or complete; the damage to each nerve can range from bruising to tearing. This is also referred to as ‘Shoulder Dystocia.’ Shoulder dystocia is a serious problem, which is often not foreseen and can result in severe injury or death to an infant. Once the baby’s head is delivered, the baby cannot breathe due to its chest and umbilical cord being compressed. The shoulders should be relaxed within six minutes otherwise there is a serious risk of brain damage. It is often difficult to know what kind of injury has occurred and different injuries may cause the same symptoms. There are four types of brachial plexus injuries:
- Avulsion - the nerve is torn from the spine
- Rupture - the nerve is torn but not where it attaches to the spine
- Neuroma - occurs when scar tissue develops around the nerve as it heals resulting in reduction of signals to the muscles
- Praxis - occurs when the nerve is damaged, but not torn and heals on its own
Failure to carry out the necessary procedures will usually result in an Erb’s Palsy compensation claim.
Our Lawyers at RLS are specialists in dealing with birth injury claims - particularly those where a child has developed Erb’s Palsy as a result of negligence at birth. We can discuss your case with you and help to put together the evidence needed to show that your claim was caused by a failure of medical procedures.
